Why Timing Matters for SIJS Applications

For children and youth seeking protection through Special Immigrant Juvenile Status (SIJS), time is one of the most important factors. While SIJS offers a path to safety and lawful permanent residency, the window to apply is limited. Families in Washington should understand these deadlines to avoid missing out on this critical immigration relief.

The Age Requirement

Under U.S. immigration law, applicants for SIJS must be:

  • Under 21 years old at the time of filing Form I-360 with U.S. Citizenship and Immigration Services (USCIS).
  • Unmarried throughout the process.

This means that once a youth turns 21, the door to SIJS is permanently closed. Even if they would otherwise qualify, they can no longer apply.

Why Early Action is Key

Although 21 may sound like plenty of time, the SIJS process requires two major steps:

  1. State Court Findings – A Washington family or juvenile court must issue findings that reunification with one or both parents is not viable due to abuse, neglect, or abandonment. These findings are typically made through a parenting plan, guardianship, or dependency order.
  2. USCIS Petition – After the court order is issued, Form I-360 must be filed with USCIS.

Because state court proceedings can take months, waiting too long to start can push a child dangerously close to their 21st birthday deadline.

The Impact of USCIS Backlogs

Even after filing, SIJS cases can be affected by delays in the immigration system. USCIS backlogs and visa number availability may slow down the process of moving from SIJS approval to permanent residency.

While these delays are outside a family’s control, starting the case early ensures the youth is “in line” before deadlines expire.

Real Risks of Waiting

Families who delay SIJS applications may face serious consequences:

  • Losing eligibility once the child turns 21.
  • Struggling to secure court orders in time.
  • Missing opportunities for work authorization or lawful status protections.

In many cases, waiting just a few extra months can mean the difference between gaining permanent residency and losing access to SIJS forever.
