How Parenting Plans and Guardianships Connect to SIJS Cases in Washington

Special Immigrant Juvenile Status (SIJS) is often described as an immigration process, but its foundation actually begins in state family courts. In Washington, two of the most common legal tools that play a role in SIJS cases are parenting plans and guardianships.

Understanding how these orders connect to SIJS is critical for families, caregivers, and youth seeking protection.

Why Family Court Matters in SIJS Cases

Before a child or young person can apply for SIJS with U.S. Citizenship and Immigration Services (USCIS), they must first obtain what’s called a predicate order from a state court.

This order confirms three things:

  1. The child is under the custody of the court, a parent, or a guardian.
  2. Reunification with one or both parents is not possible because of abuse, neglect, or abandonment.
  3. Returning the child to their country of origin is not in their best interests.

In Washington, predicate orders are often established through parenting plans or guardianship arrangements.

Parenting Plans and SIJS

A parenting plan is a legal order in Washington family courts that sets out who has custody, visitation, and decision-making authority over a child.

For SIJS purposes, a parenting plan can:

  • Establish that one parent has sole custody because the other parent is unfit due to abuse, neglect, or abandonment.
  • Show the court’s finding that reunification with the non-custodial parent is not viable.
  • Provide the legal structure needed to move forward with an SIJS petition.

Parenting plans are particularly helpful when one parent is involved and supportive, but the other parent cannot provide safe or appropriate care.

Guardianships and SIJS

Guardianship is another legal pathway in Washington that connects directly to SIJS eligibility. A guardianship order gives a non-parent (such as a relative, family friend, or foster caregiver) legal responsibility for the child.

In SIJS cases, guardianship can:

  • Establish that neither parent is able to care for the child.
  • Provide the court with a clear basis for finding that reunification is not possible.
  • Ensure the child has a stable legal custodian while pursuing SIJS.

Guardianships are especially important for vulnerable youth who may have no safe parent to return to.

Why Legal Guidance is Critical

Although parenting plans and guardianships may sound straightforward, the connection to SIJS makes them complex. The court’s findings must be worded carefully to meet immigration law requirements. Without the right guidance, families risk having their SIJS petition delayed or denied.
